Significant event to be reported:
Follow-up on the ad hoc announcement dated November 7th, 2013 with regards to the Eco Premium investigation by the Romanian Competition Council against OMV Petrom

As communicated through the ad hoc report dated November 7th, 2013, OMV Petrom S.A. filed an appeal against the Bucharest Court of Appeal decision of rejecting OMV Petrom’s S.A. request of annulling the Competition Council Decision no. 97/2011 regarding the result of the antitrust investigation concerning the withdrawal of the retail product Eco Premium (unleaded gasoline pre-mixed with lead substitute) from the Romanian fuels market.

On April 22, 2016, the High Court of Cassation and Justice allowed by majority of opinions the appeal of OMV Petrom S.A. and partially modified the challenged decision, in the sense that it partially allowed the court claim of OMV Petrom S.A. The High Court of Cassation and Justice partially annulled art. 2 point 1 of the Competition Council Decision no. 97/21.12.2011 issued by the Competition Council with respect to the amount of fine applied to OMV Petrom S.A., which is reduced to the amount of RON 297,806,409, representing 2.6% of the turnover in 2010. The decision is irrevocable.

The appeal filed by OMV Petrom Marketing S.R.L. (100% subsidiary of OMV Petrom S.A.) against the Bucharest Court of Appeal was also allowed by the irrevocable decision of the High Court of Cassation and Justice and the amount of the applied fine was reduced to the amount of RON 109,830,425 representing 2.4% of the 2010 turnover.
